The Prosecutors within the National Anticorruption Directorate – the Territorial Service Brașov ordered the indictment, without taking them into pretrial detention, against the suspect:

POPESCU TĂRICEANU CĂLIN CONSTANTIN ANTON, President of the Senate, charged for the following offences:
- perjury
- favoring the perpetrator.

MARIAN MARIUS DORIN, charged for the offence of perjury.

The indictment drafted by the prosecutors indicated the following state of facts:
Within the investigative activities taking place on April 15, 2016 regarding the case related to the possible illegal restitution of a surface from Snagov forest and Băneasa Farm, with a testimony taken under oath, the defendant Popescu Tăriceanu Călin Constantin Anton has made statements that were not consistent with the truth about the critical details of the case on which he was asked and did not say everything he knew about the critical circumstance, thereby aiming to prevent/ hinder the investigations and criminal liability of the defendants prosecuted within the indicted case, communicated through the press release no 654 from May the 18th, 2016.

Thus, the defendant Popescu Tăriceanu Călin falsely mentioned that he did not know about the following facts:
- The restitution in the favor of Paul Philippe Al României of a plot of land in Băneasa (the former royal farm) and Snagov (the forestry plot of land Fundul Sacului)
- The involvement of the defendants Tal Silberstein, Beny Steinmetz, Moshe Agavi and of other people in the restitution procedures
- The buying-selling documents related to these goods.

Also, Tăriceanu Călin Constantin Anton has made statements that were not consistent with the truth and did not declare everything he knew about the relationship with the defendants Andronic Dan Cătălin and Silberstein Tal and Truică Remus, within the above-mentioned context, the meetings and conversations he had with the latter people regarding the notary taxes related to the selling of the above mentioned buildings and the methods of acquiring and selling of these restituted goods. Within the same context, the defendant indicated that he did not have a close relationship with the defendant Marcovici Marius, while he was hiding the fact that he was not aware of the latter person’s relationship with the defendant Tal Silberstein.

Also, the defendant Popescu Tăriceanu Călin Constantin Anton falsely stated that he did not introduce Tal Silberstein to other politicians from Romania.

As part of the investigative activities carried out in this case, on April the 28th 2016, the defendant Marian Marius Dorin has made statements that were not consistent with the truth and did not declare everything he knew regarding the employment of Marcovici Marius Andrei as a personal counselor within the Chancery of the Prime Minister Popescu Tăriceanu Călin Constantin Anton, as result of his deal with Tal Silberstein. Also, the defendant Marian Marius Dorin falesely stated that he was not aware of the activity and job related tasks of Marcovici Marius Andrei, while the latter was well-known within the political circles as being „Tal’s man”.

The file was sent for trial to the High Court of Cassation and Justice.

It should be mentioned that this stage of the criminal proceedings represents, according to the Criminal Procedure Code, the completion of the criminal investigation and the referral of the case to the court, for trial, a situation which cannot, under any circumstances infringe the principle of presumption of innocence.
