By its criminal decision no. 927/A from the 5th of May 2023, the Bucharest Court of Appeal ordered as follows:
1. It ruled the conviction of the defendant VLĂDESCU SEBASTIAN-TEODOR GHEORGHE, Minister of Finance at the time the offences were committed. Thus, the defendant was convicted to a punishment of 7 years and 4 months imprisonment and the court denied the defendant the following rights both during and for a period of 4 years after the execution of the prison sentence: to be elected in public authorities or in any other public offices and to occupy a position involving the exercise of state authority and to occupy a position or to practice a profession or conduct an activity of the same nature as the one the defendant used in order to commit two offences of taking bribe.
2. It ruled the conviction of the defendant COSTEA MIRCEA-IONUȚ, former employee within the Minister of Finances, holding a management position within a state bank at the time the offences were committed. Thus, the defendant was convicted to a punishment of 6 years imprisonment and the court denied the defendant the following rights both during and for a period of 4 years after the execution of the prison sentence: to be elected in public authorities or in any other public offices and to occupy a position involving the exercise of state authority and to occupy a position or to practice a profession or conduct an activity of the same nature as the one the defendant used in order to commit the offence of complicity to taking bribe.
The court ordered that the criminal proceedings against the defendants DASCĂLU CONSTANTIN, BOUREANU CRISTIAN-ALEXANDRU and M.M., be discontinued in respect of the offences for which they were being prosecuted, as the statute of limitations had expired.
The court ordered the special confiscation of the sums of RON 3,990,248.6, € 65,000 and € 2,177,000 from the defendant Vlădescu Sebastian Teodor Gheorghe.
The court ordered the special confiscation of the sums of RON 3,121,328.41 and € 1,919,900 from the defendant Costea Mircea Ionuț.
The court ordered the special confiscation of the sums of RON 3,083,498.71 and € 1,050,087 from the defendant M.M.
The court ordered the special confiscation of the sum of €1,114,000 from the defendant Dascălu Constantin.
The court ordered the special confiscation of the sum of € 2,111,799.71 from the defendant Boureanu Cristian Alexandru.
The court ordered the special confiscation of the sum of € 214.874.88 euro, transferred in the account opened in the name of SC T.P.P. SA at the National Agency for the Management of Seized Assets. This order will be communicated to the National Agency for the Management of Seized Assets.
The court orders each of the following defendants Vlădescu Sebastian-Teodor-Gheorghe, Costea Mircea-Ionuț, Dascălu Constantin and Boureanu Cristian-Alexandru to pay the amount of RON 85,000, as judicial fees to the state and the defendant M.M. to pay the sum of RON 80,000, for the same purpose.
Final decision
The defendants were sent to trial by the National Anticorruption Directorate – the Section for Combating the Offences Assimilated to Those of Corruption on the 13th of November 2019, see press release no. 904/VIII/3 from the 15th of November 2019.
