The anticorruption prosecutors sent to trial the following defendants for committing a fraud of 88,000 Euro, to the European Communities budget:
- OPRISAN GEORGIAN, administrator of S.C. MODERN TURISM & CATERING S.R.L. Braila, for committing the offence of using or presenting false, inexact or incomplete documents or statements, which resulted in obtaining undue funds from the general budget of the European Communities or from the budgets managed by them or on their behalf, with extremely serious consequences, a deed provided by art. 181 paragraph 1,3 of the Law no.78/2000,
- NEGREANU - ARBOREANU LIVIU – ALEXANDRU, representative of S.C. TOP SWEETS INDUSTRIE T.S.I. S.R.L. and S.C. LEAR COMIMPEX S.R.L, for committing the offence of complicity to the offence provided by art. 181 paragraph 1,3 of the Law no. 78/2000.
The evidence gathered during the criminal investigation showed that:
On March 31st 2004, S.C. MODERN TURISM &CATERING S.R.L. Braila, represented by the defendant Oprisan Georgian, signed a grant contract at the value of 147,975 Euro, out of which, 88,000 Euro represented non-reimbursable financing from the PHARE funds.
The contract was signed as a result of the approval received for the financing request submitted by S.C. MODERN TURISM &CATERING S.R.L. within the Program for restructuring the enterprises and professional reconversion – the financing component of the small and medium enterprises.
During September - October 2004, in his capacity of administrator al S.C. MODERN TURISM & CATERING S.R.L. Braila, the defendant Oprisan Georgian submitted to the R.I.C.O.P. Office Galati inexact documents (customs statements, certificates) regarding the origin of several pieces of equipment used to make bread, purchased within the project called „Modern – a new challenge in the process of making bread”, resulting in obtaining undue European funds which were not reimbursable at the total of 81,000 Euro.
During the same period, the defendant Negreanu - Arboreanu Liviu - Alexandru, in his capacity of representative of S.C. TOP SWEETS INDUSTRIE T.S.I. S.R.L. and S.C. LEAR COMIMPEX S.R.L., helped the defendant Oprisan Georgian in his attempts to dissimulate the real origin of several pieces of equipment purchased within the Project, by providing the inexact documents which Oprisan Georgian used.
The Ministry of Economy and Finance – the Central Finance and Contracts Unit is a civil party in the trial for the sum of 81,189 Euro. The defendants’ assets and properties have been seized in order to recover this prejudice.
