In addition to the press release no. 1824 from November the 19th 2015, the Information and Public Relations Office is authorized to provide the following data:
The prosecutors within the National Anticorruption Directorate – the Section for Combating the Offences Assimilated to Corruption have ordered the start of the criminal investigation and the pretrial detention for 24 hours, starting with December the 3rd, 2015, against the defendant ȘOVA DAN-COMAN, acting as a Senator, charged with the offence of traffic of influence.
The preventive measure was ordered by the prosecutors, taking into account the status of Senator of the above mentioned defendant, that the condition provisioned by the a Romanian Constitution was met, meaning that the plenary of the Senate agreed with the request of pretrial detention and arrest against the defendant Șova Dan-Coman for the above mentioned offence.
The prosecutor’s order for pretrial detention and arrest indicated that presently there data and clues describing the following state of facts:
During October 2011 - July 2014, the defendant Șova Dan-Coman claimed amounts of money and received the total amount of 100,000 Euro from a denouncer, in exchange for trafficking his real influence with the defendant Bălan Mihai, general director or the thermal energy unit CET Govora SA. The latter was expected to make sure that a contract of legal assistance was signed with a certain attorney’s office, based on a monthly subscription, for a value of 10,000 Euro/month. The defendant Șova Dan-Coman was informed about his legal status and charges, according to the provisions of article 309 of the Criminal Procedure Code.
On December the 3rd 2015, he will be brought to the High Court of Cassation and Justice for trial, with a proposal for pretrial arrest for 30 days.
It should be mentioned that the start of the criminal action represents a stage of a criminal trial regulated by the Criminal Procedure Code, a situation which cannot, under any circumstances, infringe the principle of presumption of innocence.
