In addition to the press release no. 1504/VIII/3 from September 24th 2015, the Office for Information and Public Relations is authorized to inform as follows:

The prosecutors of the National Anticorruption Directorate – the Territorial Service Ploiești have ordered the launch of the criminal action and the adoption of the judicial control measure for 60 days – starting with October 7th 2015 – against the defendant ROCHE BRUNO-DANIEL-PAUL, general director of S.C. Apa Nova S.A. Bucharest during October 2008 - September 2013, who was charged with the offence of buying of influence.

Moreover, the anticorruption prosecutors informed the chosen defenders of the suspect LAURENT LALAGUE, general director of S.C. APA Nova S.A. Bucharest during September 2013 – June 2015, on the fact that the prosecutors have ordered for the investigation against their client to continue for the offence of buying of influence.

The prosecutors’ ordinance for the judicial control shows that there are data and evidence outlining the following state of facts:

During 2008 – 2014, the defendant Roche Bruno-Daniel-Paul, in his capacity as administrator of S.C. APA Nova S.A. Bucharest and general director of the same company, following a previous understanding with the defendant Semenescu Ovidiu-Traian, he gave significant sums of money under the guise of some contracts concluded with commercial companies owned or controlled by the defendants Semenescu Ovidiu-Traian, Moisescu Vlad-Octavian and Berevoianu Costin. In reality, the object of these contracts has never been executed. The documents drawn up for this purpose had been drawn up in order to give an impression of legality and justify the transfers of money.
In exchange for the money thus obtained, the defendant Semenescu Ovidiu-Traian used his own influence or the influence of intermediaries on the representatives of several public institutions from Romania. He did it for the benefit of several economic agents who are part of a group of foreign companies including SC APA Nova SA Bucharest.
Most payments corresponding to these contracts had been authorized by the defendant Roche Bruno-Daniel-Paul, in his capacity as general director of SC APA Nova Bucharest SA, some of them being made from a bank account accessed exclusively by the decision making factors.
The money thus given represented in fact, payments for the influence and interventions exercised by the defendants Semenescu Ovidiu-Traian, Moisescu Vlad-Octavian and Berevoianu Costin on the representatives of public institutions, especially the Mayor’s Office and Local Council of Sector 1 Bucharest, the City Hall of the Capital and the General Council of Bucharest. The defendants exercised their influence and intervened in favor of SC APA Nova SA Bucharest and the group of companies in which it is involved.

While under judicial control, the defendant Roche Bruno-Daniel-Paul must abide by the following requirements:
a) to come to the criminal investigation authority, to the judge of the preliminary chamber or to the court whenever he is called,
b) to inform immediately the criminal investigation authority about any change in his address,
c) to come to the police body appointed to supervise him, according to the supervision schedule designed by the police organ or whenever he is requested to do so,
d) not to leave the Romanian territory, unless the judicial authorities had previously agreed with it,
e) not to communicate, directly or indirectly, in any way, with the people mentioned in the prosecutor’s ordinance for the judicial control,
f) not to own, use and carry guns,

The defendant Roche Bruno-Daniel-Paul was informed that, in case he violates his legal obligations in bad faith, the measure of the judicial control can be replaced with the house arrest measure or the pretrial detention.

The prosecutors are investigating other people in this case.

The defendant Roche Bruno-Daniel-Paul was informed about his legal status and the charges brought against him, according to the provisions of article 309 of the Criminal Procedure Code.

The prosecutors benefit in the investigation of this case from the specialized support provided by the Romanian Intelligence Service.

It should be mentioned that the launch of the criminal action represents a stage of the criminal proceedings regulated by the Criminal Procedure Code, carried out in order to propose some preventive measures, an activity which cannot, under any circumstances, infringe the principle of presumption of innocence.
